Acceptance of Terms
By installing, accessing, or using any BetterApps product or service (collectively, the "Services"), including the BA Popup Upsell and BA Post Purchase Shopify apps, you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, do not install or use the Services.
Eligibility & Accounts
To use the Services, you must have an active Shopify account in good standing and be at least 18 years old or the age of majority in your jurisdiction. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate, current information and to keep it up to date.
Description of Service
BetterApps provides Shopify apps designed to help merchants increase revenue through upsell and cross-sell functionality. The Services integrate with your Shopify store and operate under Shopify's platform terms and API policies. We may add, modify, or remove features from time to time.
Subscriptions, Fees & Billing
Certain features of the Services are offered on a subscription basis. Subscription fees are billed in advance through Shopify's billing system and are stated in USD unless otherwise noted. Except where required by law, fees are non-refundable. Subscriptions renew automatically for successive billing periods until cancelled. You may cancel at any time through the Shopify App Store; your plan will remain active until the end of the current billing period. We may change our fees upon reasonable notice, with changes taking effect at the start of your next billing period.
Acceptable Use
You agree not to: • Use the Services in violation of Shopify's Partner Program policies, API terms, or Terms of Service • Attempt to reverse-engineer, decompile, or extract source code from the Services • Use the Services to send unsolicited communications or spam • Misrepresent your identity or affiliation when using the Services • Interfere with or disrupt the integrity or performance of the Services • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
Intellectual Property
BetterApps and its licensors retain all intellectual property rights in the Services, including all software, designs, trademarks, and content. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable licence to use the Services solely in connection with your Shopify store. Any feedback or suggestions you provide may be used by us without obligation to you.
Third-Party Services & Shopify
The Services depend on and integrate with Shopify and may rely on other third-party services. Your use of Shopify and any third-party services is governed by their respective terms, and we are not responsible for their availability, accuracy, or practices. If your Shopify account is suspended or terminated, or if Shopify changes or discontinues its platform or APIs, your access to the Services may be affected.
Data and Privacy
Your use of the Services is also governed by our privacy policies, which are incorporated into these Terms by reference. Each app has its own privacy policy describing how we collect, use, and share information, available on our Privacy page (/privacy).
Service Availability and Support
We aim for high availability but do not guarantee that the Services will be uninterrupted or error-free. Scheduled maintenance will be communicated in advance where reasonably possible. Support is provided via email at support@betterapps.pro and via live chat during business hours (Mon–Fri, 9:00–18:00 CET).
Modifications to the Service
We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services, except as expressly stated in these Terms.
Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will meet your requirements or that any results obtained will be accurate or reliable.
Limitation of Liability
To the maximum extent permitted by law, BetterApps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or goodwill. Our aggregate liability arising out of or relating to the Services shall not exceed the amounts paid by you to BetterApps in the twelve (12) months preceding the event giving rise to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless BetterApps and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
Termination
We may suspend or terminate your access to the Services at our discretion if you violate these Terms or if continued operation creates legal or security risks. You may terminate these Terms at any time by uninstalling our apps from your Shopify store. Upon termination, your right to use the Services will cease, and any provisions that by their nature should survive termination will remain in effect.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Lithuania, without regard to its conflict-of-laws principles. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Vilnius, Lithuania.
Miscellaneous
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and BetterApps regarding the Services and supersede any prior agreements. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.
